The OEM released a statement about the patent infringement case it has recently begun against aftermarket companies, naming 18 defendants.
The case was first revealed earlier this week, with The Recycler reporting that ILG and MSE had been named in the case, and Canon’s official statement on the proceedings has named another 16 companies that it accuses of patent infringement, as well as the patent numbers that the companies are said to have infringed.
In addition to ILG and MSE (listed as Wazana Brothers International, Inc.), the remaining 16 defendants were named as:
-Acecom, Inc. – San Antonio
-American Internet Holdings, LLC
-Aster Graphics, Inc.
-Aster Graphics Co., Ltd.
-Green Project, Inc.
-Ink Technologies Printer Supplies, LLC
-Innotex Precision Ltd.
-Jiangxi Yibo E-tech Co., Ltd.
-Print-Rite Holdings Ltd.
-Print-Rite N.A., Inc.
-Print-Rite Unicorn Image Products Co. Ltd.
-The Supplies Guys, LLC
-Union Technology Int’l (M.C.O.) Co. Ltd.
The patents that the defendants are accused of infringing include: 8,135,304; 8,280,278; 8,369,744; 8,433,219; 8,437,669; 8,494,411; 8,532,533; 8,565,640; and 8,630,564. Canon added that the cartridges “are sold for use in more than 50 models of Canon and HP laser beam printers”, with the OEM seeking “damages and injunctive relief”.
The OEM also stated: “Throughout the development, sales and marketing process, Canon respects the intellectual property of other companies and individuals and expects others to similarly respect Canon’s intellectual property rights. Canon remains committed to pursuing legal enforcement against those who do not respect Canon’s intellectual property.”
Static Control, the largest manufacturer of aftermarket imaging systems and components, also released a statement in reaction to the case, noting: “Static Control anticipated the most recent lawsuits by Canon against 11 cartridge manufacturers, remanufacturers and resellers regarding the extended drive shaft gears. The drums and gears affected are those used in cartridges for the HP P2035/2055 and P3015.
“Aftermarket drum manufacturers believe their drums and gears do not infringe. However, Static Control has designed a drum gear to be used with the OEM drive shaft that eliminates the risk of infringement. We will make these available to genuine cartridge remanufacturers only.”
